The Problem

On March 30, 2010, President Barak Obama signed into law the Health Care and Education Reconciliation Act of 2010.  A portion of the Act requires that every American purchase health insurance, or be subject to a penalty.  This so-called “individual mandate” has been challenged by plaintiffs across the country.  This year’s CBA Moot Court Competition problem examines whether Congress exceeded its authority under the Commerce Clause of Article I, Section 8 when it created the Individual Mandate.
