TOPIC: Making Available, Linking and Free Expression under the Copyright Act Even though the U.S. has signed on to WIPO Copyright Treaty Article 8, providing that authors will have the exclusive right to the "communication to the public" and "making available" of their works, the "making available" right has never been incorporated into the "bundle of rights" under Section 106 of the Copyright Act. The Copyright Office recently argued that "making available" is subsumed by the other Section 106 rights. However, given the Copyright Act's co-existence with the First Amendment, there are serious doubts as to whether the U.S. can fully embrace the concept of "making available" adopted by other countries.
