discusses individual liability in the context of employment discrimination litigation: under Title VII of the Civil Rights Act of 1964 -- a statutory tort prohibiting discrimination in employment -- a victim may only be able to obtain legal against his employer, and not from the individual or group of individuals who perpetrated the harassment. This presentation will discuss (i) alternative laws, including 42 U.S.C. 1981, whereby a victim of discrimination may hold his harassers directly accountable, (ii) the reasons an attorney may wish to go after the harassers in their individual capacity, and (iii) considerations for employers.
