Responding to Proposed Client Perjury and Other Misconduct: Ethical and Constitutional Considerations
What should a criminal defense lawyer do when he or she learns that a client wants to commit perjury or procure perjured testimony? Ethical rules require a lawyer to prevent and rectify frauds on the tribunal. But they also prohibit a lawyer from revealing damaging information about the client, except in the narrowest of circumstances. The Fifth and Sixth Amendments furthermore guarantee the defendant the right to testify in his own defense and the right to zealous representation of counsel.
