TOPIC:
Practice of IP Law Under the AIA: Where Are We Now?
SPEAKERS:
Kenneth Adamo, Kirkland & Ellis LLP
Dr. Kevin Noonan McDonnell Boehnen Hulbert & Berghoff LLP
David Callahan, Kirkland & Ellis LLP
Since the Leahy-Smith America Invents Act ("AIA") was signed into law on September 16, 2011, many practitioners have been asking themselves how the AIA impacts their practice and what changes they should be aware of as more of the AIA's provisions come into effect.
Together they will address the following issues relating to IP practice under the AIA:
* Preparation and prosecution of patent applications;
* Prior user rights and the balance between trade secret protection and public disclosure; and
* Post issuance proceedings involving validity in front of the USPTO: supplemental examination, post grant review and inter partes review.
