TOPIC: COMMERCIAL LENDING IN THE JUDICIAL SYSTEM
Will address a number of intriguing questions that commercial lawyers face from time to time, such as: Can a claim be considered secured for some purposes but not other purposes? Can a UCC Financing Statement terminated in error be revived by a Correction Statement? Is a default interest provision inapplicable on the maturity of a note because it was in an unexercised acceleration clause? Does a UCC Financing Statement scheduled to expire while a debtor is in bankruptcy lapse if it isn't continued? Can a mortgage recorded before the deed to the mortgagor be avoided in bankruptcy? Under the Banker's bond must a counterfeit title certificate be an imitation of an actual certificate? Is a bank liable to a borrower for misrepresenting the permitted use of property the borrower acquires with bank financing using the bank's attorney?
